Off Road Diesel Fuel

I pulled into a gas station today that sells off road diesel fuel.  I know nothing about it other than it is about 40 cents per gallon cheaper than the taxed stuff.
Is this legal to use in a boat?
I assume that, other than the color, it performs the same.  Is that correct?

I'm with Ron on this one. The shrimp fleet here on the Texas coast uses the marine or commercial diesel, but I burn the TAXED at a place that sells a lot of fuel. You are right, it is illegal to burn the untaxed fuel in a recreational boat, I think. Like Ron says, " at a 1/2 gal an hr, its no big deal".
I do think it is the same fuel.

I always keep my tank topped off and I buy my diesel fuel at a filling station on the way to Breezer. Why should I sail several miles to a marina for a couple of gallons of fuel? I pay the road tax on this fuel, although I'm not using the road. How can using taxed road diesel in a recreational boat be illegal? The illegality would exist if I bought untaxed marine diesel and used it in my car or truck, thereby avoiding the road tax.
